(1) The Supreme Court may, in accordance with Article 134 of the Constitution of Nepal, refer a case under consideration in a High Court to the Supreme Court for trial, hearing and settlement.
(2) The Supreme Court may, in accordance with the clause (2) of Article 134 of the Constitution of Nepal, order a case pending in one High Court to be processed, heard and set aside in another High Court.
(3) The High Court may, in accordance with clause (2) of Article 145 of the Constitution of Nepal, order that a case pending in one of its subordinate district courts be heard in another subordinate district court.
(4) Whether or not there is a condition to transfer the case as per sub-section (2) or (3) will be decided based on the information obtained from the application of the relevant party of the case or from the inspection or report of the court.
(5) If there is any reason why a case filed in a court should not be heard by a judge of that court in accordance with this Code, the relevant court shall send a report to the court hearing the appeal mentioning such matter and if the report is received accordingly, the court hearing the appeal shall also consider the convenience of the parties and remand the case to its own jurisdiction. Can be transferred to another court of the same level of jurisdiction.
(6) If there is an order in accordance with sub-section (2), such court shall proceed, hear or dispose of such case in accordance with the order of the Supreme Court.
(7) According to sub-section (2), (3) or (5), even if the case is decided by another court, the appeal shall be taken in the court hearing the appeal of the court where the petition was initially filed.
